Dear Court User,
Beginning this week, to ensure that courts are prepared for upcoming Juvenile Clean Slate changes, JIS will begin the process of reviewing and identifying eligible charges to be set aside. Before the end of the year, courts will begin to see indicators within their case management applications that certain records have been set aside. However, please keep in mind that these records cannot be treated as set aside until December 30, 2023, when the Clean Slate legislation officially takes effect.

As part of an effort to identify eligible offenses to be set aside in your case management system, JIS will be requesting that each court review a few areas of critical data for accuracy. This will ensure that the correct charges are programmatically set aside, pursuant to MCL 712A.18t legislation. Additional information is included in the Juvenile Automatic Set Asides memo that was sent to courts in mid-May.
Previously, JIS requested courts verify PACC codes that are ineligible for set aside and send discrepancies to jis@courts.mi.gov. To ensure you are on track for the automated set aside process, please submit this data as soon as possible if you have not already.

To assist with this ongoing process, JIS will be providing instructions to review areas of the case management systems. The first review is of PACC codes that are ineligible for set aside. The automatic set aside process conducted by JIS differs between Circuit and Juvenile courts. Unlike Circuit court, for Juvenile court, JIS will first identify all charges that cannot be automatically set aside. The linked instructions provided will pertain to Juvenile petitions only.
